1. Introduction & Acceptance

These Terms & Conditions ("Terms") govern your access to and use of www.checkdepot.com, including any related mobile applications or services (collectively, the "Site"), as well as the purchase and use of any products offered by Check Depot. By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or place any orders.

Check Depot reserves the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of any changes constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically.

2. Orders and Purchases

2.1 Products

Check Depot provides business checks compatible with accounting software programs, personal checks, deposit books, envelopes, rubber stamps, and related products. We reserve the right to modify, discontinue, or alter any product at any time without notice.

2.2 Order Acceptance

Your order is an offer to purchase our products. We reserve the right to accept or decline your order for any reason, including but not limited to:

  • Product availability
  • Errors in product or pricing information
  • Problems with your order information
  • Suspected fraudulent activity
  • Suspected violation of these Terms

2.3 Pricing and Payment

  • All prices are listed in US Dollars (USD)
  • Prices are subject to change without notice
  • You agree to pay all charges associated with your order, including applicable taxes and shipping fees
  • We accept various payment methods through our secure checkout system
  • We reserve the right to modify, add, or remove payment methods at any time without prior notice
  • Check payments:
    • Orders paid by check will be held until payment is received
    • We allow up to 60 days for check payments to be received
    • Orders will be automatically canceled if payment is not received within 60 days
    • Check payments may be held up to 10 business days after receipt to ensure clearing before order processing begins
  • For orders shipping to Canada, you are responsible for any applicable duties, taxes, or customs fees

2.4 Production and Shipping

  • Orders placed before 3:00 PM CT Monday through Friday typically ship the next business day
  • Certain products, including personal checks, one-write checks, and manual checks, may require additional production time
  • Production and shipping times are estimates only and may vary based on:
    • Product availability
    • Current production capacity
    • Order complexity
    • Payment verification
    • Other operational factors
  • We ship to addresses within the United States, its territories, and Canada
  • Risk of loss and title for products pass to you upon delivery to the carrier
  • You are responsible for providing accurate shipping information
  • Additional shipping fees may apply for Canadian deliveries

2.5 Returns and Refunds

  • Orders may be eligible for refund prior to entering production
  • Once an order has entered production, refunds are at Check Depot's discretion
  • Defective products must be reported within 30 days of receipt
  • We will work with you to resolve any issues with your order, which may include:
    • Reprinting the order
    • Issuing a refund
    • Providing store credit
  • Shipping costs for returns may be your responsibility unless the return is due to our error

3. Intellectual Property

3.1 Website Content

  • All content on the Site, including but not limited to text, graphics, logos, images, product designs, software, user interface designs, audio clips, video clips, digital downloads, data compilations, and any other materials (collectively, "Content") is the property of Check Depot or its licensors

3.2 Trademarks

  • All trademarks, service marks, trade names, and logos displayed on the Site are the property of Check Depot or its licensors
  • Nothing contained on the Site should be construed as granting any license or right to use any trademark without Check Depot's prior written permission
  • Any unauthorized use of our trademarks may violate copyright laws, trademark laws, privacy and publicity laws, and other applicable laws and regulations

We grant you a limited, non-exclusive, non-transferable, and revocable license to:

  • Access and view the Site for personal, non-commercial use
  • Place legitimate orders for products
  • Use the features we make available to you as part of our services

3.4 Restrictions

    • Edit or remove any review at our discretion

  • We do not guarantee acceptance by foreign banks, including but not limited to:
    • Canadian banks which may have different endorsement requirements
    • International banks with varying check specifications
    • Foreign financial institutions with unique formatting requirements
  • Customers are responsible for verifying their bank's check requirements before ordering

6.2 Product Accuracy and Verification

  • Customers are responsible for:
    • Verifying all information on checks is accurate before use
    • Ensuring proper check number sequences
    • Confirming routing and account numbers
    • Testing checks before use in critical transactions
  • We are not liable for:
    • Banking fees, overdraft charges, or other financial penalties resulting from check errors
    • Losses due to incorrect information provided by the customer
    • Damages resulting from the use of misprinted checks without prior verification
  • Customers should verify check accuracy immediately upon receipt
  • Any printing errors must be reported within 30 days of receipt
  • Claims for printing errors or defects after 30 days will not be accepted
  • This 30-day period begins when the product is delivered to the shipping address provided

6.3 General Disclaimer

  • All products are provided "as is" without warranty of any kind, either expressed or implied
  • We disclaim all warranties not explicitly stated in these Terms
  • We are not liable for any consequential, incidental, indirect, or special damages arising from the use of our products

6.4 Printing Specifications

  • Colors shown on your screen may vary from actual printed products due to monitor settings and limitations of digital display
  • Minor variations in color, positioning, and cut margins are normal and acceptable in the printing industry
  • Paper stock colors may vary slightly between batches
  • We reserve the right to make minor adjustments to artwork to ensure optimal printing quality

6.5 Business Information Verification

  • We reserve the right to verify business information provided for check orders
  • Orders may be delayed or cancelled if we cannot verify business information
  • We may require additional documentation to process certain orders
  • Submission of false business information will result in order cancellation and may be reported to relevant authorities

7. Dispute Resolution

7.1 Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee
  • Any dispute shall be subject to the exclusive jurisdiction of the courts located in Tennessee

7.2 Dispute Process

  • Parties agree to attempt good faith resolution of any disputes
  • Any legal action must be brought within one (1) year after the cause of action arises
  • The prevailing party shall be entitled to recover reasonable attorneys' fees and costs

7.3 Limitation of Liability

  • Our total liability for any claim arising from or relating to these Terms or our products shall not exceed the amount paid for the specific order giving rise to such claim
